The most common form of bail is the commercial bond.
Here you pay a bail bondsman a fee with is a percentage of the total bond. Typically it is 12% but the exact amount is regulated by each state’s insurance commissioner.
A small portion of this amount is the fee for the bondsman’s services.
The remainder is used to execute an insurance contract obligating the bail bond company for the remainder of the bond should the offender miss court. The contract pays the full bond.
When the case is over, the arrestee is not entitled to any refund.
However, should the person flee the jurisdiction and skip court, he and whomever helped secure the bond are obligated to the insurance company for their loss.
